Over a year ago I bought a vehicle from a dealer not knowing the engine in the car was not the engine the manufacturer made. The engine started running poor. I took the car to the manufacturer’s authorized dealer to replace the engine. As they always do before replacing any one’s engine, performed tests and the results revealed that the VIN on the engine and that on the car does not match so they can not replace the engine. Can I take this to Court?

You may have a potential case. If a dealer sold you a vehicle with an engine that isn’t the one the manufacturer made, depending on the facts related to the sale, you could potentially pursue claims for fraudulent misrepresentation, breach of the implied warranty of merchantability under the UCC, and deceptive trade practices under the Colorado Consumer Protection Act (C.R.S. §6‑1‑101 et seq.).
