My neighbor built a makeshift carport in his driveway. However, he included a gutter that extends and dumps into my yard. It has no cap on the end, just jagged metal and could injure someone walking on my property. I asked him 10 days ago to keep it off my property. He has yet to move it and is actively avoiding my husband and I. Am I legally allowed to cut it back to his side of the fence? Am I legally liable if someone gets injured by the gutter on my property?
