My Mother owns 3 apartments in Denver. We have decided to sell one because of her declining health. One of the tenants is on a month to month so that's the one we decided to sell. We delivered a Notice to quit to him, and gave 90 days. He has decided not to pay rent for the final month and I was told I can't serve an evection because the Notice to quit wasn't delivered properly. Please help.

We are happy to assist you with this situation. Colorado eviction laws have undergone significant changes in recent years, particularly around the notice requirements for terminating a tenancy.

While you provided 90 days’ notice, there may have been specific procedural issues with how the Notice to Terminate was delivered, which could affect your ability to proceed with an eviction. Additionally, a tenant’s failure to pay rent during the final month does not automatically negate the notice period, but it can complicate matters if the notice wasn’t delivered properly.

We have attorneys specifically focused on evictions in Colorado and can guide you through the process. Our attorneys have handled hundreds of evictions. Please contact us at 303-688-0944 or text us at 833-691-7255, and we’ll be happy to help.
