If I were to relinquish my parental rights, what would the child support process look like? Would I still be obligated to pay? For how long? My child is 6 months and the mother is unbearable plus I never get to see her.

If you relinquish your parental rights and the court approves it, you would no longer be obligated to pay child support, as you’re no longer legally responsible for your child. However, in Colorado, a parent cannot voluntarily relinquish parental rights unless there is another legal guardian, such as in cases of infant or step-parent adoption, ready to take over responsibility. The court requires a new guardian to be in place before allowing relinquishment.

If relinquishment is not an option in your situation, there may be other alternatives to consider, such as reducing your child support payments or seeking parenting time rights.

I recommend contacting an attorney to explore the best options for your case. If you’d like to speak with one of our family law attorneys, please call us at (303) 688-0944. We’re here to help.
