We live in a small development and their is a HOA, however they are very loose on enforcing the rules. When we built in this community the HOA states your yard needs to be put in within 1 year with certain guidelines, which we followed. It also has guideline’s for what the exterior the house has to be and so on… So the HOA does not really enforce these consistently! We have new neighbors who have been there a year and 8 months who have done nothing to their yard, they are in violation of the covenant by 8 months. The homeowners has every excuse in the book, one being well I couldn’t get a landscaping plan because of the Pandemic! He is still sitting not doing anything to the yard and its full of weeds! We have contacted the HOA but they do not be to concerned, which is typical. What is our legal right with this HOA?

Your HOA Board of Directors has a duty to enforce the HOA rule fairly against all homeowners for the benefit of the remaining homeowners. However, it is not unusual for HOA Boards to be unwilling to enforce the rules on neighbors. Often a Demand Letter from an attorney will convince the Board that it is time to take action. If you want our help all you need to do is schedule a free case assessment with one of our attorneys by calling 303-688-0944 or online at https://calendly.com/case-assessment/case-assessment. At your appointment, we'll meet by phone or video (Zoom), we'll discuss the facts, your concerns, desired results, rights, remedies, the law, the process, timeline, how we can help, costs, etc.
