HOA has asked us to remove a 8×10 Tuff Shed in our back yard that we just had built. My husband is a 100% disabled veteran who suffers from recurrent episode of PTSD and unable to socialize. The Tuff Shed is a place where he could go and work on therapy projects till he is able to socialize. We have asked the HOA for an accommodation, showing medical records and have been denied and they have threatened to put a lean on our home unless we remove it, All because our neighbor doesn’t want to look out and see the shed. My question is, is this not discrimination?

Fighting the HOA is not easy. If your HOA does not specifically disallow sheds then you should be able to obtain approval. If your HOA rules specifically disallow sheds then your reasonable accommodation argument needs to be pursued. I recommend scheduling a free case assessment with one of our HOA attorneys to engage your HOA on your behalf. Just call 303-688-0944 on schedule online at robandhen.wpengine.com/locations
