Our Colorado POA is having an election redo as the first election was not valid. The same board is up for re election as well as 3 new candidates trying to replace this board. They have mailed out proxies and the POA manager is collecting the proxies but we are told the board members are able to view these proxy forms and count them. Is this appropriate? We believe they are trying to estimate the number of votes in their favor. Any advice is appreciated.

The board may be attempting to estimate the outcome of the election. The rules are dependant upon your POA's covenants and bylaws. I recommend that you contact us to review those rules then discuss your rights, remedies, and other options.
