Denver’s Fox 31 News asked Robinson & Henry attorneys if a business has to tell reveal employee’s criminal record or pending criminal charges.
R&H Criminal Defense Attorney Ryan Robertson said businesses must be careful when considering whether to expose an employee’s criminal charges.
“An allegation or a charge is just that, there’s been no finding or conviction,” Ryan said. “If the employer gets it wrong, they can find themselves in some sort of civil hot water,” said Robertson.
On the flip side, Robinson & Henry Personal Injury Attorney Jon Topolewski added that “if the business is aware that person is an offender and can be a threat to minors on the property, that business could have a liability civilly.”
Jon and Ryan agree that the best way to protect your child is to search whether a business’ employees are on the registered sex offender list.
