HOA Pays Up for Condo Repairs After Demand Letter

If you're a Colorado homeowner, chances are you belong to a homeowner’s association (HOA). HOAs make and enforce rules and guidelines for subdivisions, planned communities, or condominium buildings.

Because HOAs have very little governmental oversight, it is common for board members to overstep their bounds. While litigation is often necessary when battling unwieldy HOAs, a strongly worded demand letter from an HOA litigation attorney can sometimes do the trick. 

After purchasing a condo, our client found a leak and exposed pipes in the wall behind the sink. She determined the leak was coming from the unit above hers, and a remediation company repaired the resulting mold and moisture. Later, a plumber found four additional leaks — all originating from the unit above our client's condo. The HOA refused to pay for the repair costs, and our client was seemingly stuck with the mess.
