It’s frustrating when a departing roommate abandons their personal belongings instead of renting a storage unit. Frustration turns to stress when that roommate sues for the monetary value of the items left behind. This happened to one of our clients named in a replevin action filed by their former roommate. 

A replevin action is used to recover personal property taken by someone else. However, the court must find evidence of wrongful possession of the property for the action to be successful. 

In this case, the former roommate claimed our client wrongfully possessed roughly $40,000 of their personal property. Our Litigation Team presented evidence in court to show our client repeatedly asked the ex-roommate to retrieve their belongings. The replevin action was unsuccessful and the judge did not order our client to return the items.
