October 10, 2023 — Disputes between co-owners of real property are common, especially when the parties decide to go separate ways. This kind of real estate dispute is resolved by filing a partition action. It’s a type of lawsuit that essentially asks the courts to make a final decision about the property. In this case, Robinson & Henry Partner and Civil Litigation Attorney Joe Lico guided a partition case to settlement, recovering $475,000 for our client.

Typically, the law favors dividing up real property among the interested parties in partition actions. That’s not always possible if the property is a house. In that case, selling the home is often the most viable option after which the parties share the proceeds. However, not every case needs to be resolved in court. Attorney Joe Lico, a skilled litigator and negotiator, was able to achieve a satisfactory out-of-court settlement, which saved our client time and money.
