Mother Wins Custody Relocation Battle

When a couple separates, it can be hard to anticipate what the future holds for either spouse after the divorce. If the divorced couple are parents, deciding what comes next has limits, especially if it involves relocating.  

When it’s in the child’s best interest, Colorado courts prefer that a child has frequent interaction with both parents. Sometimes, one parent may move out of state for work or to be closer to family. However, that parent must prove to the court that moving the child away from their home state and their other parent is in their best interest.

In this case, a mother sought our help after her ex-husband moved out of state and wanted to relocate their child with him. Our family law attorneys provided the court with substantial evidence demonstrating why this relocation was not in the child’s best interest. As a result, the motion was dismissed and the child continued to live with their mom in Colorado.
