Robinson & Henry client Dean shares his experience navigating a property dispute, shedding light on the critical role R&H had in not only providing legal counsel, but also peace of mind.
Grateful for the firm’s help, Dean sat down with R&H Marketing to discuss his situation and his experience working with Civil Litigation Senior Associate, Alex Lowe.

Quest for Legal Clarity in a Dispute With Neighbor
Living in Colorado means breathtaking mountain views and pristine nature, but it also comes with its own set of challenges. That’s when Dean learned the hard way when his secluded mountain property became a magnet for trespassers and squatters.
“It was a big, big problem. We had people squatting on our land, and these weren’t destitute people. These were just people that just wanted to kind of hang out in the countryside,” said Dean.
The situation escalated when Dean was walking on his property and two dogs attacked him. Shaken by the experience, Dean decided to speak with his neighbor about putting up a gate around his property, but the gate would encroach on the common space shared with a neighbor.
Journey to Seeking a Solution
Dean’s story is a common property issue, and it’s one that many homeowners may face: a neighborly dispute of easements and land use.
Colorado easement law governs the rights and responsibilities associated with easements, which are legal rights to use another person’s property for a specific purpose.
“We approached the other owner and said, listen, you know, we have people constantly coming on to our land and we need to do something about it. He proposed that we build a gate together and then it kind of spiraled out of control because who would that gate belong to?” said Dean.
Dean felt lost and overwhelmed, unsure where to turn for legal help.
He said his first mistake was going with a different small, local firm, not Robinson & Henry. The first law firm Dean worked with made a crucial error in their contract, which triggered a legal nightmare. As a result, Dean encountered a series of setbacks that escalated the situation rather than resolving it. This led to threats of lawsuits and heightened tensions with his neighbor.
“The contract got written up incorrectly and it came across to the other party as if we were in essence, barring him from his property and stealing part of the land where the gate was going,” Dean explained.
R&H Provided Clarity and Solutions
It became clear to Dean that he needed to seek new legal counsel. He turned to Robinson & Henry and was impressed by the firm’s reputation and trustworthiness displayed by Civil Litigation Senior Associate Alex Lowe.
From the initial consultation, Dean felt a sense of trust and confidence he said he hadn’t experienced before.
“Alexander I immediately trusted, and he has that kindness. He has confidence, and he really sort of exudes also experience. Those three things combined, I think are really a powerful combination. And I was just flat out impressed.” Dean explained.
Alex patiently listened to Dean’s situation, explained the complexities of the situation in clear terms, and never sugarcoated the truth.
He provided Dean with options. He outlined the legal battle, acknowledging the potential victory but also the emotional and financial toll it would take.
Through Alex’s guidance, Dean gained a clear understanding of his legal rights, which is exactly what Dean needed.
Dean said Alex empowered him with knowledge and confidence, helping him understand the difference between legal rights and personal feelings, ensuring he wasn’t swayed by his neighbor’s intimidation tactics.
The Outcome: Peace of Mind
After working with Alex, Dean said he walked away with a clear understanding of his rights and a deep sense of gratitude toward Robinson & Henry.
“I am immensely grateful, and beyond just the legal aspect of it. Also, the confidence aspect, meaning that you really feel confident that you know what your rights are, and you really know where the line is, where people can violate your legal rights,” said Dean. “And to me, that peace of mind is worth its weight in gold and more.”
