What I want to talk to you today is briefly about probate and the issue of common law spouse claims in an intestate estate or an estate without a will. Colorado is one of the few states that recognizes common law marriage. And the issue, what happens to the lawful heir sometimes is a boyfriend or girlfriend or even a roommate can make a common law spouse claim into an intestate probate when there is no will. So it’s important for the lawful heirs of a decedent to file for probate in order to protect their rights against any unlawful common law spouse claims.
